Does he need a lawyer?

He’s a high school dropout with no job.
His mom never married and is a drug addict who just got out of jail to continue smoking crack.

He’s gay, bi-polar, and unemployed in Flint.

What are the chances he will be successful with his petition?

He’s 17 (and 2 months old) and doesnt want to be bothered by Child Protective Services.

I am 17 years old and belong to an upper middle class family. We aren’t exactly rich but we are not hurting for money.

My problem is I am an underage father to a very sick baby that has to deal with totally unmanagable parents in law(to be).

My son has Gastroschisis which is a disease in which his whole digestive system has herniated and basically leaked out of his body from an ir-regular orifice. He will risk infection once out of the hospital.

They plan on taking him to a very small cramped apartment where my son, girlfriend and her parents will live with the accompanyment of a dog and 3 unfixed cats. Where on more than one occasion I have found fecal matter in the bath tub and witnessed the cats urinating in the sinks and ovens and varies other items.

The Grandmother or legal guardian over indulges in alcoholism at least 3 times a week and is “hungover” and vomitting atleast 70% of the time and is unemployed without income.

The Grandfather is hardworking at 13 dollars an hour and is overworked and still is having a hard time providing him with anything not even a medical or dental plan that he would have if he lived with us and two working and a soon to be employed father.

Yesterday, While at a meeting for an appointment of my sons the neonatal doctor said that “everything will be told to the mother and the father primarily.” which seemed to upset both of my girlfriends parents to where he came out and said “They are minors, I’m gonna be the one raising the kid and I don’t even have to put this guy(referring to me) name on the birth certificate and he doesn’t even have to be involved, so if your going to be telling them i’m going to get lawyers involved” which I found to be very embarassing on his and mine, my girlfriend and my sons behalf.

So, I think its time to take matter into my own hands, and if they want to get lawyers involved then I’d like to have a sure fire way of fighting back and if able gain custody of my son. My parents would be behind me 100% of the way. Also the Grandfather threatened to take me out to the “parking lot” on a few occasions for me voicing my opinion on some matters.

I think its unfair…what are my rights as the babies father and what can I do to either establish my rights or gain custody?

it especially upsets me because me and the girlfriend have a very close relationship but her parents are honestly driving me away, because on more then one occassion have they been rude and disrespectful to me and my family, while all i’ve done is stick by my girlfriend and face my responsibilities…I could have left and ditched like many 17 year old boys would have done…but no even with a sick baby to look after I decided to stay with the woman I love and care for him even though her parents are acting like complete jerks…but I just decided I’ve had about enough. I live in Canada BTW.

Let me give you the lowdown first:
My mother is a single woman raising 1 child, 15 years old on SSI. My other sister, a 30 year old, irresponsible, (we think) drug addict, has up and left her children at my mother’s home one day to go running around with her friends, she hasn’t been back for more than a few minutes at a time since.

Someone called DHS due to the abandonment and DHS wants to take the children into fostercare due to my sisters volitale behavior. They’ll leave the children in my mother’s care as long as she has custody of some sort. Otherwise my sister can come in and out of their lives and take them and then leave them again at her will, because she doesn’t think about the safty and well being of her children. Now, if Sis takes the kids, DHS will step in and put them into foster care because she is not a fit parent and Mom doesnt’ have custody. They’re basically floating in limbo right now.
We desperately need a legal document that gives Mom custody of these kids so that they are safe from being ripped out of this family. They are very loved and cherished in home with Mom and myself, Mom’s neighbor.
I’ve posted this in another forum… This is how desperate we are.

We’ve been through the lawyer thing. Lawyers cost money that neither of us have. We wanted to find out about documents that we can file pro-se (without an attorney). We might be able to get her to sign over on her own and we might not (hopefully we can) we just need to know how to legally word it so that it is not nullified when it’s filed in the court system.

I am wondering what the legal rights are for fathers who pay child support?

The custodial parent is unemployed and an alcoholic, and demands that the father be supervised when he tries to visit, threatening him when he tries to take the child to see his grandparents, etc. It’s ridiculous, and he’s emotionally very discouraged. What are the steps he should take to make her a more responsible party? She lives with her parents and is milking him financially and emotionally. I don’t know that it is best for the child to be with her, but he is hesitant to take her to court and take the child from the mother, as well as feeling generally not up to the challenge of taking full custody. What should he do,and what role should I play as an outsider/girlfriend? I am willing but completely inexperienced with children, and I don’t want to traumatize the child but the current situation is making the father miserable and I believe the child may be suffering from things related to her alcoholism and drug abuse.

As an adult sister-how to get legal custody of 9 year old brother?

I’m 23 & have been living on my own and supporting myself since I was 17 years old & I’m doing pretty well.
My mother has always been an extremely abusive alcoholic and when I was a minor she severly physically, mentally, and emotionally abused me. I have a 9 year old half-brother who lives with her(neither of our fathers are in the picture).She doesnt physically abuse him but she neglects him and emotionally abuses him. She is drunk since the early morning sometimes and he is terribly afriad of her and wants to live with me.However, she has a nice home,a car, & makes sure he always has food and clothes.Its more about the fear and lonliness she makes him feel. I want to try to take her to family court to get custody but do I have a case here?The home he lives in is fit and she is able to hide her alcoholism very well and not drink for days at a time, sometimes even weeks.But it always comes back worse then ever. Would I be able to prove she is unfit? Anyone that knows law,please help.

Why is alcohol excepted and pot not besides the legal factor?

Alcohol is much much worse then pot is. I know people who lost it all. My aunt became an alcoholic and would drink day or night. She lost her job, custody of her child, and her house because she didn’t pay her bills. To top it off, she received 2 DUI. When she did used to drink, she neglected her kid, while she drank and got drunk. It doesn’t get any worse then that. She is doing better now and doesn’t drink at all. My co workers step son died because his liver failed and they refused to give him the transplant because it was all due to drinking. My step dad used to hit my mom when he drank to much because liquor made him aggressive and violent. I don’t know anybody who lost everything because they decided to smoke a few joints. Pot does not make you aggressive or violent. Everyone that I know still fullfills their obligations before they smoke. My one friend holds a job making 60 grand a year and lives on his own and hes been smoking for 10 years and he never went to any harder drugs
The only difference is pot is illegal and alcohol is legal. Just because pot is illegal does not make it morally wrong.

Their mom has 4 children, the 2 youngest being my brothers’ kids. The mom chose a party life and is now hard on drugs, and a party animal. She is definitely an unfit mother. My brother lives with us in our apartment, he got out of rehab last year for being addicted to pain killers. He still smokes pot. Me and my husband want to get full custody of the kids, but where do I even begin? Help!

She doesn’t want to have an abortion and plans to keep the baby, but she is knowingly living a very unhealthy lifestyle.

I mean, it’s HER body. But it’s also HIS child, so should it really be HER choice?

What can really be done if the mother decides she wants to abuse her body and that of her unborn child? We can’t very well put her in prison and FORCE her to be healthy, can we?

So im 15 and living with my uncle right now because my mother is in a rehab and my father also has drug problem . But i hate living with my uncle . So my mother has custody of me . But my friend’s mother agreed to let me stay at their house where I used to live so that I can be where I grew up . So what legal way would I have to go about this ? Would my mother just need to give my friends parent consent to have me ? Or would we need to go thro court ? PLEASE HELP ME
So , all I need is my mother to say okay ? Does she need to sign any paper work or anything so my friends parent can prove guardianship and etc to enroll me in school?

What are my rights as a step dad? I have a 13 year old step son and a 5 year old daughter with the same woman. When ever it comes to disciplining him, she feels that she must protect him from me because I might make him mow the lawn or do the dishes when all he really wants to do is smoke pot and stay out till 2 a.m. It’s incredible that his mother would let this 6″ tall boy walk out the house and right past her as she mows the lawn, & argue with me when I say something about it! And frankly I’m F*%Kin sick & tired of it! He comes up pos. in a drug screen from his school, they tell me that they want him in an out patiant program or he’s going to be suspended come Sept.,& her responcse to me was”they did’nt tell me” and she acts as if it ain’t so. Come Sept. she’ll see. I got a 5 year girl I have to worry about too. He’s going to be an influance to her. I love him and I want to help him straighten out his life.His mama is may biggest adversary in helping him. Legally what are my rights!

Is it legal for a Custodial mother to move out of state without the fathers permission?

Ok im not sure if anyone knows but I live in FL and my husband has a little girl who’s 8 by another woman, well about a year ago she moved up to OK, and what i was wondering was is it legal for her to do that, he is paying child support and has been for about 7 yrs now i know the child support has nothing to do with it but he doesnt get to see her, until now they came down for a week and its been over a year since he has seen his little girl, her mother is listed as the cusodial parent and he is the non-custodial parent does he have any say in what she does, we need to know what we need to do, we have had her for three days and were suppose to take her back tonight but when we got to where they were staying noone was there(her mother knew what time we were bringing her home) and my husband called and she said to leave her with the neighbor which the little girl doesnt know, and i told him no that she could come and get her from our house, come to find out the mother is out drinking and said she couldnt come and get her..its a messed up situation what can we do if anything???

Im looking 4 a way 4 my husbands father 2 stop his wife from accessing money & credit. For years, shes been a binge spender (her latest is $80K+ over 14 mo’s on an internet clothing business thats sold $0), depleting all except for a $40K 401(k) (b4 paying off $60K+ in CCard debt). My father-in-laws 74, & wont b able 2 work much longer 2 pay 4 her spending. Its begun 2 affect his health since he cant afford 2 have any elective medical procedures b/c they have no money. She always finds a way 2 get more money/credit: shes stolen her husbands computer passwords so she can transfer funds & even stolen her sons identity 2 obtain 3 CCards when he was in college! If she doesnt stop, they will lose their home. After my husbands father dies, it’ll be our responsibility 2 ensure she doesnt go homeless (& it’ll also give her motive 2 try 2 steal the savings weve accumulated). Shes not incompetent, just stupid & selfish! Is there a specific field or law (non-criminal) that would help with this???

My friend is 17. Her mother is abusive and an addict. My friend is responsible, has a job, and has actually taken care of her abusive mother for too long. She finally had to leave on her 17th birthday when her mother beat her in her broken arm and then fed a sob story to the police. But people tell her different stories so we are unsure if the legal adult age in Georgia is 17 or 18.

Hi there. My mother is in a coma due to overdosing and her organs are failing. I am suppose to talk to a lawyer and a social worker tomorrow but I am trying to find some information tonight.

I am 19 years old, soon to be 20. My younger brother just turned 15. How do I go about becoming his legal guardian when my mother can not give her legal consent? Also, what happens if my mother wakes up or if she wants to regain custody after coming out of a rehab program?

my mother signed a legal document of mine WITH my permission is it still legal?

I am involved in a case where I am trying to win a lawsuit against my late father’s drunk widow for his estate. My mother has written and signed some of the documents needed for this case. Now it seems my father’s widow has realized this and wants to charge my mother and I with fraud. Is this possible if I gave my permission for her to sign? My mother is not allowed to have anything to do with my father’s estate according to their divorce decree from the early 90′s. I am really worried does the drunk widow have a case? Did we commit fraud?

My friend just found out her 16 yearold daughter has been drinking since the age of 12 because when ever she spent the night at her best friend’s house her friends mom would buy them both alcohol. This stopped about a year ago when my friends daughter and the other daughter stopped being friends, but my friend and I still think she should have some consequences for giving such yound children alcohol, what can we do?

Dear Sir:
I am not sure to send this e-mail when I have finshed it. I’m praying it makes it’s way into the right hands..I desperately need some intervention. My story is long and I apologize if I don’t tell it well but it truely comes from my heart…
In June of 2004 my husband and I took in my cousins children. 2 beautiful girls that immediatly stole our hearts. We agreed to this only because we were told the parents were giving them up for adoption. They said we had to wait for them to get out of jail to sign the papers..We trusted them. A months later the mother was released from county jail and we had to return the girls. In November of the same year and the mother called us again and asked if we could keep the children for 6 months while she went back to jail. No one else wanted them. They were 1 & 2 yrs old. Of course, we took them back gratefully. The mother ended up doing 13 months in prison on drug charges…The father did too.
My husband and I called every agency including DCFS to try to keep custody of the children and was told we were to far down the blood line to have any say in the children and that it was DCFS’s policy to clean the parents up, not to remove the children. Once again, we had to turn the children over and the mother refused to let us see them for 7 months.
In September of 2006, I get another call from the mother asking if I’ll take them and put them in school because she had no one to take care of them. Of course, I went and got them. I had them for another for another 11months.
In August of 2007, the grandfather was released from prison and reunited with the grandmother, who was also recently released from prison, decided they wanted the children back where they lived so once again, we had to return the children. 3 months later my husband and I gave up our jobs and apartment and moved to the city the girls lived in so we could at least see them. That month, the mother went back to jail, the father was released from prison and the children lived at their grandparents and we weren’t allowed to see them.
In August of 2008, my husband and I had to move where there was work and begged the mother when she got out of jail to let the kids come w/ us and we would help her find a place and get off the dope. The following month, the mother was busted smoking crack and the children were placed with the grandparents thru Luthern Services.We have not seen them since!!! We have been approved for visitation over a year ago but denied the visits because their Grandparents doesn’t want us to have anything to do with them so DCFS abided by their wishes. I can’t understand why the children were placed with them in the first place. They both have extensive histories of prison, violence and drug abuse just like the parents.
I recently called Luthern Services and was informed that the grandparents want to adopt which means we will never get to see the children we have loved and raised all these years. Don’t we have any rights? I have called agency after agency for the last 5 years trying to adopt these kids. I have followed all the rules and depended on the system not to fail us or the children but once again it has done just that!!! Can we contest the adoption and file ourselves? This is so unfair to us and the children. If you can get them away from the grandparents and convince them you wont tell, they will tell you the want to live with us. Each time we have had to turn them over they had to be pried out of our arms. Isn’t there anyone out the who can help us? All of us!!! Imagine loving and raising 2 children as your own all this time then be denied of seeing them ever again. This is just wrong on so many levels!!! Even if we cannot contest the adoption, is there anyway we can legally get some type of visitation? We are desperate. Everyday without them is a living hell!!! It’s like part of us is lost. Please help us or at least point us in the right direction for help. We have about 6 months before the adoption and we don’t know what else to do!!!

I have been doing internet searches for weeks but can’t seem to get anywhere. Just more phone #s of people who “can’t help” us. I was hoping to come across someone here that might have the right answers, not to cry “boo hoo” !!!
I forgot to add than I live in Central Illinois and I have called several attorneys and the few that will concider want huge retainers and all the others don’t want to fight DCFS. I have been calling state agencies for the last 5 years trying to get these children removed from that environment.
