Getting custody of my stepson.?

I have a 2 year old stepson who was born when my Fiance and his ex were 14 and 15. She lets us get him every other weekend and every Sunday. My Fiance pays childsupport and hasnt missed a week in 2 years. His mother does not work and lives with her parents and younger sister. NO one in her house works they live off of disability and are known to be involved in drugs. His mother has seizures and recently got her license even though she could have an episode at anytime while driving with my stepson in the car. She has been to “Charter” (a rehabilitaion center) for mental rehab. We are expecting our first child together anytime now. We live on our own and both have respectible jobs. Along with a paid off vehicle. He calls me mama and screams every Sunday when we take him home. His father and I love him so much… and even though we both work an expensive attorney is almost out of the question. Any suggestions?

I need advice on getting fully custody of child!!!?

So it is not my child but it is my nephew, my brothers child.
Heres the story:
My brother and his soon to be ex wife are fighting for custody of my 2 year old nephew. The mother is a pyscho. She is ALWAYS sick. There have been NUMEROUS times where I, my sister, or my mother have had to take off work because she couldnt watch him and if my brother did then he would get fired… she has been like this since I can remember… she just recently got out of rehab for drugs after checking herself in. My brother has her recorded admitting atleast 2 times that she has been on drugs and has even had my nephew there while she has been high and so on and so forth. My brother has an order of protection on her and he has temporary full custody and she only gets one supervised visit for 2 hours. Which I hope she doesnt get to see him ANYMORE.
My brothers attorney is crap and because my brother couldnt pay him in full the attorney is doing very little for him… so I recently got a loan out for my brother so he can hire a new attorney.
When she did get to see my nephew he came home starving. & she used all her families first to buy drugs..
Do you think my brother will end up getting full custody??? She is sending threatning texts and we are saving all of them to show to the judge.
Is there anything else we can do to up the chances of him getting full custody??
Please help! I dont want my nephew around her! She is very unfit!!!
Add: She was only in rehab for 2 weeks and I HIGHLY doubt that she has fully recovered

In a child custody battle do I have the right to a court appointed attorney if I cant afford one?

I am very confused with this case. My very own mother, who is a drug addict and has many mental health issues such as Bipolar Disorder, Manic Depression, Schizophrenia with Psychotic Episodes as well as does the man that she married 2 years ago that she met in a Psychiatric Hospital and only knew for 3 weeks before she married him, took custody of my girls from me. My ex husband stabbed me 4 times in the face and neck 2 days after Christmas and left me for dead. Luckily I survived. I took my girls and went to live with my mom because I had no where else to go and she told me she was going to help me. I was having a very hard time sleeping at night because of the nightmares and I was having panic attacks. My mom started giving me xanax to help me sleep and stay calm. Out of nowhere, my mom went to the DHS and made up a bunch of lies and told them I was all strung out on drugs which was not true. I asked for a drug test and they refused to give me one. When we went to court, the judge would not even let me speak the first word or defend myself. I didn’t have an attorney. I had no clue that she had made up so many horrible lies on me and all the while she was on drugs herself. My mom was issued temporary emergency custody of my girls. I was ordered to do a drug program. I had a full time job and I asked if I could do outpatient and I was told no. When I finally got the court order 6 months later, it said impatient was preferred not ordered. So I couldn’t complete an impatient program because I had a home, a car, and I still financially supported my girls. The company I worked for went out of business in May and I immediately began a new job. That job ended in September and I immediately began another job. When I went back to court in October, my mother gave custody to my ex husbands great grandmother and great aunt. They ordered me to have no contact with my girls and I dint understand why. In court, they jumped my case saying I should have done outpatient and I tried to explain to the judge that I called and asked my caseworker and she told me that it was unacceptable. Its a messed up court system. I wasn’t even allowed to speak in court. I tried to speak one time and I was told that if I spoke again I would be held in contempt of court. So all I could do was remain quiet while my so called mother sat right beside me and lied on me. The judge told me I had to quit my job and the only thing I was to do now was go to rehab. Well, I quit my job. I am on a waiting list to get into a rehab that I found that would take me without insurance. I have at least 4 more weeks left on the waiting list. I go to court in March and I know his family is going to fight me for full custody. I dint know what to do. I am by far not a bad mom. I have never so much as spanked my kids ever. I have taken care of them by myself while being in a very abusive relationship with their father. I ha vent spoken to or seen my girls in 2 months today and Im about to lose my mind. My girls love their Mommy and they cry to be with me. They carried them out of the courtroom crying that they want their Mommy and they love their Mommy and she is not a bad person. Its killing me to know that they want me so bad and I cant do anything about it. No one has even explained to my babies why Im not there. They have no clue what is going on. Its so unfair!!!!!! I don’t understand how this could happen when they had no evidence against me. All they had was my moms word and she is legally crazy!! I cant afford an attorney now because the judge ordered me to quit my job till I go to rehab. I need an attorney to represent me in court in March or I could possibly lose custody of my girls for good and for no reason at all. Can anyone help me with this situation?? All I want is my babies back so we can go back to being a family like we were before my husband tried to kill me. I love my babies with all of my heart and would never put them in harms way and they will tell you that themselves. What do I do before I do lose my mind??

I have talked to a lawyer but I am still afraid that my ex will get joint custody of our child.
let me explain a moment, my ex is addicted to narcotic pain medication..he recently had a job related injury which gives him an excuse to get perscriptions I have proof that he filled 4 perscriptions for percocet, all within a 3 week period. he has been to rehab for his addiction. he currently lives with his alcholic mother who has been in and out of rehab for years. his drug addiction makes him mean and intern he has thrown our child into her crib by her arms. I dont want to sound mean, I want him to be apart of her life..I just want her to be safe. If he would agree to go to couseling I would feel a little better about it, but he states he doesnt have time and hes not going to put his life on hold..

police were called but she was home already.son told police she made him do it.she blew a .19.kids were released to me full time and social services was call.she then tried to kill herself that night.no custody has ever been established yet.what are my chances of getting full custody while shes in rehab (for the 3rd time and she has 3 dui’s on record)

I want to know how and if she has just cause. My friend has a niece (age 9), and 2 nephews (ages 5 & 4). Their parents are separated. Their father has been to rehab a few times for hard drugs and their mother was on drugs and we believe she still is. Their parents are no longer together. The father works out of town during the week and only sees them every other weekend. The mother only sees the kids one day a week and the other 5 they are at the moms friends house where they sleep on the floor because the lady has kids of her own. The mother has been to court a few times for her daughter missing too much school. The 5 year old has more cavities than a normal kid. The father has a very extent record which goes from fighting to alcohol related crimes to robbery, etc, etc.. The nine year old is walking around calling everyone a crack head. She knows what marijuana is and everything. Is this grounds for my friend to file? How would she go about it?

She is about to work for the state for daycare of her other nephew and is doing online school for dental assistant and her boyfriend/fiancee works in the local laborer’s union. They are in the process of trying to buy a house which has 3 bedrooms, 2 baths. Decent yard and pool. It is also close to the local schools.
Can I have some examples on how I could prove some of this? I know there are alot of forms to fill out that will show their criminal backrounds. Anything else?

Anyone gotten custody of a baby who’s mom is addicted to pain medication?

A family member is addicted to pain meds. We were hoping that she would be more responsible during her pregnancy, but she recently went to the hospital and got a lot of morphine (she didn’t tell the hosp. that she was pregnant). We are very worried about this child, and other family members think that we would be the best people to take the baby if the mom can’t look out for him/her. We have the most stable marriage, own a home, and would be able to stand up to the mother.

Has anyone been in a similar situation? My main concerns right now are that if we’re called upon to take this child I would want full custody (I wouldn’t want the baby to be second to my own son). Also, I am not sure about caring for a baby that will probably be born addicted to drugs (morphine, vicodin, nicotine). Any knowledgeable advice would be appreciated.

Also, it doesn’t look like the dad’s going to be in the picture. He has one kid that he doesn’t take care of, and we’re pretty sure that he’s a meth addict.

What can be done with this child custody case?

A friend of mine has a 7 year old daughter who has been in his care for all of her life. Her mother stopped visiting her 2 years ago (she was 5) and has not called, stopped by to see her or contacted anyone about her daughter since that day. Two years later she filed kidnapping charges on the father of the child. At the temporary hearing, full custody was granted to the mother. The court ordered that the father immediately withdraw the child from her school, her home and her extra curricular activities to resume her life living under her mothers roof. Keep in mind that the child had not seen her real mother in two years (she was 5 years old at the time) and had grown accustomed to calling her step-mom “mommy”. The child didn’t even recognize her real mother. Her real mother was married to but seperated from another man at the time of the child’s birth. The father of the child has been living in the same house for more than 5 years and has never changed his phone number, nor have his parents. The mother claimed she did not know how to contact the father in order to see her daughter. What steps should be taken now for the child to be placed back in the care and custody of her father with whom she has been comfortably living with her entire life?

Note: The mother has two other children by two other men and is married now. She has a criminal record, a suspended drivers license and a past history of drug abuse and alcoholism. The child’s father works as a 911 emergency dispatcher/paramedic/firefighter and has had a steady job since he was 18, he is now 29.

Wife has been in rehab twice in past 3 years and has attempted suicide 2 other times. She was awarded temporary custody. I am seeking full custody due to wife’s addiction. She leaves baby with her mother who has also had drug problems. Wife’s mother also abused her severely her as a child. Consequently,she was in a number of foster homes. Wife is defending mother, stating that abuse occurred 25 years ago. Yet wife never allowed her 2 other children by a previous marriage, now 14 and 16, to stay with her mother. My attorney tells me that nothing can be done until our court date in March. I am desperate. Please help with any suggestions. Thank you.

My father has been fighting custoday for my sister who is now 11. In a nutshell, the mother is a drug addict and has been in & out of rehabs for the past 5 years. My dad left her about a year n 1/2 ago and has been trying to get custody of my sister since then. My father is retired on social security/disability and is completely capable of caring for his daugther. She is now staying with a relative b/c her mom is in another rehab. We went to court today and they are allowing the family memeber apply for temporary custody, and then let the judge decide. The family member is a sister who has never raised children an is a drug addict herself. The state also provides support for my sister through my father, which they scavange that every month! What do we do?????

Should I let my mom have custody of my son?

My son, who is 8, has been staying with my parents for the past two years. When I force him to come home, he cries, won’t sleep, and I end up letting him go back there. I have never been neglectful of my son; I am a good parent. (I also have a 4-year-old daughter who is an absolute angel.) Part of my son’s problem rests in his initial upbringing. His father was an abusive alcoholic, and I got out of that situation. Regardless of what I told the courts during our custody battle when he was 3, his dad still sees him regularly. Also, my son has some developmental disablilities, like ADHD and other behavior problems. I am married, and my son hates my husband. Every time he’s home, he says that he wants me to get a divorce and get back with his dad, and he says it in front of my husband. My son requires someone to be with him at school, and my mom goes every day, since she is a homemaker. I work full-time, I’m in school, and I have another child, so I don’t have time to do this.
Needless to say, this is taking it’s toll on my health and family. My son wants to live my parents, and even though it hurts me, I know he’d probably be happier. However, I don’t want to screw him up by letting him do this. I need advice.

Instead of giving the children to a stable father in the military ? While he was deployed she cheated on him with someone from his extended family, she was also in the hospital for overdosing on pills and alcohol, and their military housing was taken away because she kept it unlivable (their words). He is not going anywhere anymore and the courts are actually thinking of giving the kids and his car to her why?

I would like to accept a very promising job offer, however it is in Wisconsin, and I live in California. I have a five year old son who does have a relationship with his father, however, I am very worried that his father’s alcoholism is going to have a negative affect in the future. We don’t have any custody agreement in place, and my son has been in my care since he was born with and has had arranged visitiations with his father. His father doesn’t have his own place, he lives with his mother, and smokes a lot of pot, and of course drinks a lot. If I tell him I’m moving, and he doens’t like it, what can he do to keep me here, and can I use his drinking and other habits to fight for full physical and legal custody? I don’t want to start a big fight, but I’m not sure how he is going to react to my news? He may be nice about it, but just in case what are my options?

4 years ago i received a call from child services to go in to their office and talk to one of their workers about my daughter. It turns out her mother was using drugs and leaving my daughter with different relatives for weeks at a time i always knew and tried to stop it but courts always want proof as long as i received my visits she was fine they would say well because of the drug abuse they gave me the proof i needed to take to family court and was granted full custody with no visits from her mother till she did everything she was ordered to do rehab and so on at that time my daughter was 7 now shes 12 well 4 years with no contact she bettered her self and cleaned up shes taking me to court for a modification of custody her wanting full custody and now me getting visits on weekends we went to mediation and no agreement i told her i did not want to hand her over like nothing happened in this 4 years my daughter has accomplished alot and i don’t want her interrupted she feels confident because she got her other daughters back from a previous relationship back but the guy did not put up a fight he was better of giving his girls back he says IM married and have 2 other girls here in my home they don’t want there older sister to move out im okay with visits but not moving out what will happen in the first court hearing will it get resolved or is there more court battles till this conflict is resolved will she win does the judge consider her absence taking so long we signed a safety pack thru child services with her agreeint to full custody for me while seeking treatment will it help my case and the letters and reports of child services

Child custody battle? What are my options??

I would like to move out of state but have questions about custody of 5 year old. I would like to accept a very promising job offer, however it is in Wisconsin, and I live in California. 19 Year old Mom VS. Her Parents in a Custody Battle?? Help.?

My friend moved out of her house when she was 16 and pregnant with her childs father and moved in with her aunt in uncle four states away beacsue her mother was very bipolar and her father is an alcoholic. The father of her child cheated on her and she left him, forcing him to come back to connecticut to be with his parents. In Decmber of last year, she and her one and a half year old son moved back in with her parents becasue they promised things had changed. About five months in she came to the quick conclusion that her father has gotten worse and the alcoholism has gotten the best of him, and her mother was the same she’d always been. So she made the desicison to move back to indiana and get her own apartment with her son and finally be on her own due to she had a job waiting there for her. She took a quick trip out there and got a few things situated.. when she came back she voiced her decisions to her parents and they went off the wall stating “they will do everything in their power to take her son and she will not go anywhere with him”. Behind her back, a week later they filed a Immediate Temp Custody petition which she knew nothing about stating false allegations (they would have been true 6 years ago but not now. things such as mood swnings and such, human being behavior.. her mom is a little crazy and when I say that its an understatement).two days later they asked her to go pick her incapacitated grandmother up from indiana since she was moving back to ct for a while to settle some affairs. They gave her the money and sent her on her way.. While she was doing so.. the sheriff came to serve her and she wasnt there.. this was all planned and when she got back they had already held a hearing and she had no idea what was going on till she went to leave with her son one day and they told her not to and flashed papers.. she had to go get herself served so that she knew what was going on. Shes devestated and has no idea where to go next… she doesnt have a job, she planned on moving, so she can’t get an attorney.. shes stuck.. Please Help.
