Child support issues?
September 6th, 2010My brother-in-law got papers in the mail the other day saying the mother of his kids wants child support from him. Well, about 4 years ago they had the kids taken from them by CPS and my brother-in-law worked hard to get them back. He has FULL PARENTAL RIGHTS & FULL CUSTODY of all his kids. The mother messed up on a drug rehab program & lost ALL parental rights to these kids. She doesn’t even have visitation.
So how could she be requesting child support for these kids if they don’t even live with her & she doesn’t even have custody of them?
Plus on the papers it had her as the “custodial” parent. Isnt he the “custodial” parent?
What does he do about this situation?
I don’t know what state you are in, but look up the attorney general in your state on the internet. You will find contact information and call them and talk. Something is very very wrong!
i’d call them if hes legally the gaurdian, she can’t do a thing about it!
yea u better call a lawyer or something to look in on that, it doesnt sound right…..sounds like she wants money for drugs…if shes still doing it
Let me tell of a California case. A father always had custody of the five kids, but for seven years the mother claimed to Welfare that she had custody and didn’t know where the father lived.
When they finally found him, he was served with retroactive child support orders. He showed that he had always had custody, but because he had an income and she didn’t, he was ordered to pay. It was upheld on appeal.
They took his home, checking, saving, retirement fund, and 55% of the gross on his check. His family was homeless.
Jump on this right away and real hard, otherwise he gets nailed. Call the news media and get someone interested. Welfare doesn’t always make mothers prove they have custody, but they do fathers. A reporter needs to run a sting.
