At what time can we file for custody?

I have guardianship of a 7 week old baby. I have had her since day one. Her mother is in prison and is a heroin addict. She has 2 years left to do and was using drugs for the first three months of her pregnancy. She has 3 other kids and has been in trouble with social services many times before.I love this baby like she is one of mine I have 3 kids myself they are all straight a students and are very well adjusted. I do not want her to go with her mother.It would not be good.

   You can file for custody whenever you decide you want to try and have custody

   file for custody right away. as soon as possible. and if you don’t do it soon enough that mom will be out and could be potentially dangerous to the child!

   This is sad but I have a feeling they will want to give the mother a chance when she gets out of prison. It is highly unlikely that she will change but they have to give her that chance. When it fails, you can file for custody.

   NOW!! before she gets out and trys a legal case for her kid, if you do it now you have a better chance.

   file NOW!!! the sooner the better. You have been caring for this little girl and to her you ARE her mother so i suggest that you file now while the mother is in prison.
