Do you have a right to seek custody of this child if the mother is now suffering from alcoholism and has mental problems?

   I guess if you served your time for the rape you could make an effort for obtaining custody but I’m pretty sure that, give the choice between a rapist and a crazy drunk, the judge will grant custody to the crazy drunk.

   That would be up to the court to decide based on what was best for the child. Each case on it’s merits. But in this situation probably not.

   Sorry, It could never happen because I would not rape a woman.
   Maybe some others, with more experience with that type of behavior, can help you.

   The only scenario where I could see this POSSIBLY happening (granting custody to a rapist, that is) would be if it were a statutory rape where the individuals had a “consensual” relationship.

   I’m pretty sure it’s a safe bet that if you don’t rape anyone this won’t be a problem for you.
