I am 16 and I am hoping for my mother to get custody of me rather than my father but there are some problems?

My mom has a history of drug addiction but has gone through rehab and has been of probation for about six months. My father moved out of state and cannot return because he is remarried. Do you think the judge will give custody to my mother even though her past is not the greatest? This is in the state of texas by the way. Thanks!
Honestly idk what the Judge will do, i’m shure you will have a say in this, if your comforable living with your mother, then they should just leave it be. (hopefully ;)
it is your choice. but.. the fact the ur mother has had an addiction problem they might want to check on her often to see if she is able to care for you.
16 might make you legally old enough to choose, check up on your state laws.

You (usually in the courts eyes) are old enough to tell them how you feel and where you want to live. My advice is write a letter to the judge (submit it through family services or the lawyer). Tell him how she has impacted your live in all positive aspects as possible and how you will benefit from living with her (future plans and goals in the area she lives in- to better your and her life) and how moving with your dad interrupts all your plans. If you need to dish some dirt on your dad stating why you don’t want to live with her (he doesn’t support your dreams, future goals, etc.) Good luck! I hope this helps!

In all actuality, the judge doesn’t care about what you want.
The judge will do whatever seems best.
To him it doesn’t matter what seems better to you or your mom,he is going to look at your moms charges and say what he thinks.

At 16 you can go to the court and talk to the judge and have that judge change your custody. It is your right at this point. In most states, the age of self-determination of custody is 14.
Make sure your mom is up to having custody of you. If she can’t provide a stable home life, you don’t need to be there because you would actually be a greater burden for her, and thus add to her stress.
This really has to come down to what is the most stable home life for you. This isn’t about getting away from your dad’s new wife. You only have 2 years until you are 18, so you might as well follow through with your education and start holding a part-time job and save some money so you can launch right after you graduate.
