My boyfriend and I want to take his step-brother from his mother. She was an addict, and is supposed to move?
May 13th, 2010out of the state soon, we live in NJ. The boy is currently living with the grandmother. My boyfriends step-brother does not like living with her. He always says how he wants to be with us. The whole things is just messed up. My boyfriend and I know that we have to get a house for us to live in and be financially stable, which we are financially stable, and we are looking for a house. I was told that the legal age was 12 years old for a child to decide where he wants to live. so my question is are we able to take him from her if we get the correct stability for him and ourselves. Also the father passed away so he wouldnt be able to take him.
I think he can apply to become his step-brother’s guardian, but it would depend on the longevity of their relationship and it might be difficult as he has no blood ties to his brother, whereas the grandmother does. Usually this is a huge consideration – however, if the boy’s needs are not being met, a judge may rule in his favor.
