Violating Probation, Second Time?
January 11th, 2010Ok i was origionally charged wtih misdemeanor possession of marijuana and alcohol. I had 1 yr probation, 50 hours comm service, and 6months restricted license.
My first drug test i failed for cocaine, alls they gave me was 1 mothers against drunk driving class and through out the charges.
NOW i failed again like 5 months later. So i am going to sign up for a drug rehabilitation program. Whats the worse the court/judge can do to me. Add community service, add probation time, random drug tests, umm or am I going to get jail time

I dont have any time hanging over my head though. My PO said to get into a rehab program ASAP so by the time i go to court i can say I put myself in there instead of THEM putting me in there
Well, I would think that violating probation a second time would give you jail time. I look at Paris Hilton, and I think that you aren’t going to get off so easily.
And the drug rehab might be a good idea, since you can’t seem to stay off drugs, even though it means possible jail time. I hope as you sit in that jail cell, you can think back on a wonderful high, because it was the reason you are there.
I used to be a probation officer. I would recommend a 1 yr extension to your probation, add 300 hrs of community service, and demand that you were placed in a residential treatment facility with the understanding that if you violate again that you will serve every day day for day the original jail sentence.
The worst that can happen is that you get revoked and sent to jail for up to 1 year. Some states I am not sure about Virginia can give you felony charges of possession of narcotics and sentence you to up to 20 yrs in prison.
If there is any justice in this world you will be put in jail for simple stupidity and an inability to follow directions.
worst that can happen? being charged with posession of cocaine for having it in your bloodstream. least that can happen? being ordered to undergo treatment. likely to happen? revocation of probation. in most cases when someone is on probation and violates, the DA/ judge will listen to whatever the PO suggests
I think you should go to rehab for about two years.
You seem to be unable to stay off the $hit.
I have a son who has now violated his probation, after just getting out of prison. 5 years there
He has been out for 8 months.
Granted, his violation was alcohol-DUI, from what he went to prison for, (crack cocaine), but is no excuse.
Now, even the very best Lawyer that he has, he may be going back for a very long time.
We live in Va. & he’s 25
